Dear Onteora Families,

We understand that recent federal changes to policies have created concerns and uncertainty for many with regard to the safety of our students while in school. State laws and policies govern how we operate our schools and outline our responsibilities in protecting students, and New York has some of the most robust protections in the nation. You can review the State Guidance here. We are working under the guidance of our school attorneys to stay well-informed of any federal changes and to remain informed in this evolving situation.  

Although this is a complex and evolving situation, I wanted to let you know that our Board of Education and our Administration are committed to ensuring that we remain steadfast in our dedication to maintaining an environment where all students are safe. At the Board of Education meeting last night, our Board approved an updated version of a resolution they originally approved in 2017. This resolution articulates our dedication to supporting all students and the process that we are following. The resolution is:

WHEREAS, every school-age child, regardless of immigration status, has the right to access a free public education, grades kindergarten through 12 in accordance with Article XI of the New York State Constitution, and the Onteora Central School District (hereinafter “the District”) supports that right; and

WHEREAS, the District has a legal responsibility to ensure that all school-age children who reside within its boundaries, regardless of immigration status, and others as required by law, have the opportunity to attend school in the District; and

WHEREAS, through its policies and practices, the District has made a commitment to a quality education for all students, which includes a safe and stable learning environment, means of transportation to and from school sites, the preservation of classroom hours for educational instruction, and the requirement of school attendance; and

WHEREAS, educational personnel are often the primary sources of support, resources, and information to assist students and student learning, which includes their social and emotional health; and

WHEREAS, the District is committed to complying with existing state and federal law;

THEREFORE, BE IT RESOLVED that consistent with New York State Education Department (SED) regulations and guidance, the District, when registering students, will not ask questions or request information that may reveal the student’s immigration status; and

BE IT FURTHER RESOLVED that any District staff or faculty member that receives a request from the U.S. Immigration and Customs Enforcement Office (ICE) or any other federal immigration authority regarding a student or students will take no action, and will immediately forward such request to the Building Principal who will then consult with the Superintendent, who will forward to the District’s attorneys for legal advice; and

BE IT FURTHER RESOLVED that the District will not allow law enforcement to interview, interrogate, or remove a student from school property except as consistent with applicable law and Board policy; and

BE IT FURTHER RESOLVED that the District, will comply with the federal Family Educational Rights and Privacy Act (FERPA) with regard to the release of student information to any immigration authorities and will consult with the District’s attorneys with regard to compliance with FERPA; and

BE IT FURTHER RESOLVED that the District is committed to addressing incidents of immigration-related harassment, bullying, and discrimination pursuant to the Dignity for All Students Act (DASA).

I want to assure our students and families that although there may be changes at the Federal level, we continue to work to ensure the well-being of all our students, every day. Queridas familias de Onteora,

Entendemos que los cambios federales recientes a políticas han creado preocupaciones e incertidumbre para muchos con respecto a la seguridad de nuestros estudiantes mientras están en la escuela. Las leyes y políticas estatales rigen la forma en que operamos nuestras escuelas y describen nuestras responsabilidades en la protección de los estudiantes, y Nueva York tiene algunas de las protecciones más sólidas del país. Puede revisar la Guía estatal aquí. Estamos trabajando bajo la guía de nuestros abogados escolares para mantenernos bien informados sobre cualquier cambio federal y permanecer informados sobre esta situación en evolución.  

Aunque esta es una situación compleja y en evolución, quería hacerles saber que nuestra Junta Educativa y nuestra Administración están comprometidas a garantizar que nos mantengamos firmes en nuestra dedicación a mantener un ambiente donde todos los estudiantes estén seguros. En la reunión de la Junta Educativa de anoche, nuestra Junta aprobó una versión actualizada de una resolución que aprobaron originalmente en 2017. Esta resolución articula nuestra dedicación para apoyar a todos los estudiantes y el proceso que estamos siguiendo. La resolución es:

CONSIDERANDO que, cada niño(a) en edad escolar, independientemente de su estatus migratorio, tiene derecho a acceder a una educación pública gratuita, desde el Kindergarten hasta el grado 12, de conformidad con el Artículo XI de la Constitución del Estado de Nueva York, y el Distrito Escolar Central de Onteora (en adelante “el Distrito”) apoya ese derecho; y

CONSIDERANDO que, el Distrito tiene la responsabilidad legal de garantizar que todos los niños en edad escolar que residen dentro de sus límites, independientemente de su estatus migratorio, y otros según lo exige la ley, tengan la oportunidad de asistir a la escuela en el Distrito; y

CONSIDERANDO que, a través de sus políticas y prácticas, el Distrito se ha comprometido a brindar una educación de calidad para todos los estudiantes, que incluye un ambiente de aprendizaje seguro y estable, medios de transporte hacia y desde los sitios escolares, la preservación de las horas de clase para la instrucción educativa y el requisito de asistencia a la escuela; y

CONSIDERANDO que el personal educativo suele ser la principal fuente de apoyo, recursos e información para ayudar a los estudiantes y su aprendizaje, lo que incluye su salud social y emocional; y

CONSIDERANDO que, el Distrito está comprometido a cumplir con las leyes estatales y federales existentes;

POR LO TANTO, SE RESUELVE que, de conformidad con las normas y directrices del Departamento de Educación del Estado de Nueva York (SED), el Distrito, al registrar estudiantes, no hará preguntas ni solicitará información que pueda revelar el estado migratorio del estudiante; y

SE RESUELVE ADEMÁS que cualquier personal del Distrito o miembro de la facultad que reciba una solicitud de la Oficina de Inmigración y Control de Aduanas (ICE) de los EE. UU. o cualquier otra autoridad federal de inmigración con respecto a un(a) estudiante o estudiantes no tomará ninguna medida y enviará inmediatamente dicha solicitud al Director de la escuela, quien luego consultará con la Superintendente, quien remitirá a los abogados del Distrito para obtener asesoramiento legal; y

SE RESUELVE ADEMÁS que el Distrito no permitirá que las autoridades entrevisten, interroguen o retiren a un(a) estudiante de la propiedad escolar, excepto según sea consistente con la ley aplicable y la política de la Junta; y

SE RESUELVE ADEMÁS que el Distrito cumplirá con la Ley federal de Privacidad y Derechos Educativos de la Familia (FERPA) con respecto a la divulgación de información de los estudiantes a cualquier autoridad de inmigración y consultará con los abogados del Distrito con respecto al cumplimiento de FERPA; y

SE RESUELVE ADEMÁS que el Distrito se compromete a abordar los incidentes de acoso, intimidación y discriminación relacionados con la inmigración de conformidad con la Ley de Dignidad para Todos los Estudiantes (DASA).

Quiero asegurarles a nuestros estudiantes y familias que aunque pueda haber cambios a nivel Federal, seguimos trabajando para asegurar el bienestar de todos nuestros estudiantes, todos los días. Nuestros consejeros y personal de apoyo están disponibles para ayudar a cualquier estudiante que pueda sentirse ansioso o preocupado por estos cambios.
